Incoming Docs Terms of Service
Effective date: November 9, 2026 · Last updated: November 7, 2026
These Terms are an agreement between Monadnock Cyber, LLC, Amherst, New Hampshire ("Monadnock Cyber," "we," "us"), and the business that subscribes to or uses Incoming Docs ("Customer," "you"). They govern your use of the Incoming Docs service, its data and the websites at incomingdocs.monadnockcyber.ai and incomingdocs.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you sign an order with us, the order and these Terms together are the agreement. If they conflict, these Terms control unless the order expressly says otherwise.
1. Business use only
1.1 Who may use the Service. The Service is offered only to:
- licensed real estate professionals;
- real estate brokerages and teams;
- other businesses we approve;
and only for use in the course of their business. It is not offered to consumers or for personal, family or household use.
1.2 Your authority. The person accepting these Terms must be at least 18, and must be authorized to bind the Customer.
1.3 Named users.
- Each login is for one named individual who works for you. You may not share logins.
- If a login is used by someone other than the person it was issued to, we may treat each additional person as a separate subscription and charge for it.
- You are responsible for all activity under your accounts, and for your users following these Terms.
- When a user leaves your business, their access ends. Tell us promptly so we can close the account.
- Tell us at [email protected] if you suspect unauthorized access.
2. Your license
2.1 What you may do. Subject to these Terms and payment of fees, we grant you a limited, non-exclusive, non-transferable, revocable license, for the term of your subscription, to access the Service and use its data ("Service Data") for one purpose: identifying and prospecting potential real estate clients for your own business. That purpose is your "Permitted Use".
2.2 Your territory follows your licenses.
- Your subscription covers only the states where you hold an active real estate license, as you gave them to us and as we confirmed. We may narrow it further by agreement.
- You may use Service Data only for your territory. Tell us promptly if a license lapses or is suspended; your territory shrinks to match.
2.3 Who owns the data.
- We and our licensors own the Service and Service Data, including any copy you view, download, print, save or put in another system.
- These Terms transfer no ownership to you. You receive only the license above.
2.4 The data changes. Service Data is updated as public records change. At any time you may use the data as it then exists in the Service. We may add, change or remove features.
3. Prohibited uses
You will not use the Service or Service Data:
3.1 For eligibility decisions (FCRA). Not, in whole or in part, as a factor in deciding anyone's eligibility for:
- credit;
- insurance;
- employment;
- housing, renting or tenant screening;
- a government license or benefit;
- any other purpose covered by the Fair Credit Reporting Act or similar state laws.
Monadnock Cyber is not a consumer reporting agency. Service Data is not a consumer report.
3.2 To discriminate. Not to discriminate in violation of the federal Fair Housing Act or any state or local fair-housing or anti-discrimination law. Do not use it to steer or exclude anyone on the basis of a protected characteristic.
3.3 To approach anyone at home. Not to locate a physician's residence, to visit a physician at home, or to harass, stalk, threaten or embarrass anyone. Contact physicians only through the professional channels the Service shows, such as a practice address or office telephone.
3.4 To contact people unlawfully. You alone decide whether and how to contact anyone, and you are responsible for doing so lawfully. That includes:
- the Telephone Consumer Protection Act;
- the CAN-SPAM Act;
- the National Do Not Call Registry and state do-not-call and telemarketing laws;
- state real estate licensing and advertising rules;
- your brokerage's policies.
Do not place calls or texts using an autodialer or artificial or prerecorded voice to anyone who has not given the consent the law requires.
3.5 To pass the data on. Not to sell, resell, sublicense, publish, share or otherwise disclose Service Data to anyone outside your business, or use it for anyone else's benefit. The exception is a referral of a specific individual to another licensed real estate professional, as part of normal real estate practice.
3.6 For advertising audiences. Not to upload Service Data to an advertising platform, or use it to build audiences or segments for online advertising.
3.7 To build a competing product. Not to put Service Data into your own products or services, or use it to build, train, enrich or supplement any database, list, model or product that competes with or substitutes for the Service. That includes training machine-learning or AI models.
3.8 To break the law or anyone's rights. Not in violation of any law or regulation, or of anyone's privacy or intellectual-property rights.
4. Acceptable use: no automated or high-speed access
The Service is built for people working leads by hand. To protect the Service, its data and the people in it, you will not:
4.1 Use robots. Do not access, search, copy or monitor the Service with:
- robots, spiders, crawlers or scrapers;
- headless browsers;
- scripts, macros or other automated means;
except through an interface we provide expressly for that purpose and document in writing.
4.2 Access it at high speed or in bulk.
- Do not access the Service at a rate or volume faster than a person could reasonably use it through its normal interface.
- Downloads are by selection only. You may download only the leads you select, up to 50 leads per account per day, or any other limit stated in your order.
- Do not copy, save, export or cache Service Data in bulk by any other means, including saving or scraping pages.
4.3 Get around our limits. Do not circumvent, disable or interfere with:
- rate limits, download limits, usage caps or CAPTCHAs;
- authentication;
- territory restrictions;
- any other technical or security control.
That includes rotating accounts, IP addresses or devices to avoid limits.
4.4 Reverse engineer or overload the Service. Do not:
- decompile or reverse engineer any part of the Service;
- remove or alter any notice or marking in the Service or in downloaded data, including the "licensed to" and export identifiers in each download;
- probe, scan or test the Service for vulnerabilities without our written permission;
- load the Service in a way that impairs it for others.
4.5 Mislead about who you are. Do not misrepresent your identity, affiliation or licenses, or use another person's account.
4.6 What we may do.
- We use technical limits to prevent excessive use, and we monitor use for compliance with these Terms.
- We may throttle or suspend access immediately if we reasonably believe it violates Sections 3 or 4, until the issue is resolved to our reasonable satisfaction. Where we can, we will tell you first.
- If a limit gets in the way of legitimate use, ask us; we may adjust it at our discretion.
5. Keeping track of Service Data
5.1 Label the source. If you put Service Data into a CRM or other system, keep it marked as coming from Incoming Docs (for example, a lead source of "Incoming Docs"), and do not make it available to anyone who is not a user on your account.
5.2 Keep records. During your subscription and for two years after, keep records sufficient to show that your use of Service Data complied with these Terms. On reasonable notice, and no more than once a year unless we have reason to believe there is a violation, you will let us review those records. If the review finds a material violation, you will pay its reasonable cost.
6. Removal requests
6.1 When we tell you. If a person in Service Data asks to be removed, or the law requires us to stop disclosing their information, we will remove them from the Service and may notify you. We may also keep a removal list in the Service.
6.2 What you must do. Within 10 business days of our notice, and whenever the removal list shows a person you hold data about, you will:
- stop using that person's Service Data;
- delete it from any system where you stored it;
- not contact them again on the basis of it.
7. Data accuracy
7.1 What Service Data is. Service Data is drawn from public government records and our own analysis. Each lead states:
- the evidence behind it;
- the date of that evidence;
- a likelihood (for example, "likely" or "very likely");
- a confidence level, with its reason.
These are assessments, not guarantees. Public records can be out of date or wrong, and people change plans.
7.2 Verify before you rely. Use your own judgment and verify information before relying on it. We do not promise that the Service will make you compliant with any law or standard; you remain responsible for your own compliance.
8. Fees
8.1 Fees. Fees, billing period and territory are set out in your order or plan. Fees are due in advance and are non-refundable except as these Terms or the law provide.
8.2 Late payment. If fees are not paid when due, we may suspend access until they are.
8.3 Taxes. You are responsible for applicable taxes, other than taxes on our income.
8.4 Price changes. We may change fees at renewal with at least 30 days' notice.
9. Confidentiality
Service Data, our pricing and the terms of your order, and any non-public information about the Service, are our confidential information. Protect them with at least reasonable care, use them only for your Permitted Use, and disclose them only as the law requires (with notice to us first, where the law allows).
10. Suspension and termination
10.1 Ending a subscription. You may cancel at the end of any billing period.
10.2 Termination for breach. Either party may end the agreement if the other materially breaches it and does not cure the breach within 21 days of written notice.
10.3 Immediate suspension or termination by us. We may suspend or terminate your access immediately if:
- you breach Sections 3, 4, 5 or 6;
- your use creates legal risk or harm to others;
- you fail to pay.
10.4 On termination.
- Your license ends, and you will delete all Service Data, and anything derived from it, within 10 business days.
- The exception: people you actually reached. If a physician responded to your lawful outreach during your subscription, or became your client, you may keep your own records of that relationship. You may not keep or use the rest of the Service Data.
- Sections 2.3, 3, 5, 6, 9, 11, 12, 13, 14 and 15 survive termination.
11. Remedies
11.1 Injunctions. Unauthorized disclosure of Service Data can cause harm that money cannot fix. We may seek an injunction or other court order to stop it, without posting a bond.
11.2 Agreed damages for disclosure. Our damages from a leaked record are hard to measure. If you, through negligence or on purpose, disclose Service Data to someone outside your business, let them use your login, or use Service Data for someone else's benefit, you will pay us $10.00 per physician record, for each person who received or benefited from it, as agreed damages and not as a penalty. This does not limit an injunction or our other remedies for anything else.
12. Disclaimers
THE SERVICE AND SERVICE DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LEAD WILL RESULT IN A TRANSACTION.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, AND EXCEPT FOR A PARTY'S GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR BREACH OF SECTIONS 3, 4, 5 OR 6, YOUR INDEMNITY OBLIGATIONS, SECTION 11, OR AMOUNTS YOU OWE US.
14. Indemnification
You will defend, indemnify and hold harmless Monadnock Cyber and its officers, employees and agents from any third-party claim, loss or expense (including reasonable attorneys' fees) arising from:
- your use of Service Data, including any call, text, email, mail or visit to any person;
- your breach of these Terms;
- your violation of any law or third-party right;
- use of the Service by anyone you let use your account.
To claim this protection, we will notify you promptly, let you control the defense and any settlement (which may not impose liability on us without our consent), and give you reasonable help at your expense.
15. General
15.1 Governing law. These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-laws rules. The state and federal courts in Hillsborough County, New Hampshire have exclusive jurisdiction, and each party consents to them.
15.2 Individual claims only. Each party brings claims only individually, not as a plaintiff or class member in any class, collective or representative action.
15.3 Attorneys' fees. In a dispute under these Terms, the winning party may recover its reasonable attorneys' fees and costs.
15.4 Changes to these Terms. We may update these Terms. If a change is material, we will give at least 30 days' notice by email or in the Service. Continued use after that date is acceptance.
15.5 Feedback. If you send us suggestions about the Service, we may use them without obligation to you.
15.6 Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets.
15.7 Events beyond control. Neither party is liable for delay or failure caused by events beyond its reasonable control, such as outages, natural disasters or government action. This does not excuse paying fees.
15.8 Entire agreement. These Terms, your order and the Privacy Policy are the entire agreement. If any provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver.
15.9 Notices. Notices to us: [email protected] and [mailing address]. Notices to you: the email on your account. Email notices are given when sent.
